Joseph Michel de Ravel de L’Argentière coupable d’attentat à la pudeur sur des enfants
Poursuivi sous 21 accusations d’attentat à la pudeur sur huit filles de moins de 12 ans, Joseph Marie Louis Michel de Ravel de l’Argentière  a été reconnu coupable par la Cour ce mardi. 

Poursuivi sous 21 accusations d’attentat à la pudeur sur huit filles de moins de 12 ans, Joseph Marie Louis Michel de Ravel de l’Argentière  a été reconnu coupable par la Cour ce mardi. Ce dernier est aujourd’hui âgé de 58 ans et les actes ont été commis entre 1980 à 1999. Les victimes ont porté plainte en 2012 et l’affaire a été prise en cour en 2016.

Joseph Michel de Ravel de l’Argentière était poursuivi sous 21 charges, mais il avait plaidé coupable que sur 14 charges. Il avait retenu les services de Me Gavin Glover SC et Me S. Hawoldar. Durant le procès, il a été établi que l’accusé connaissait ses victimes mais ses hommes de loi ont plaidé sur “the lack of credibility on the part of the victims who delayed in reporting the matter/s, the lack of corroboration and the possibility of the victims’ recollections of the events occurring through suggestion by their therapist/s or as a collective conspiracy after the first matter was reported to the police.”

La magistrate N.Ramsoondar a qualifié cette affaire de historic sexual abuse vu que les victimes étaient très jeunes à l’époque et que ces actes ont été commis sur les enfants des amis de Joseph Michel de Ravel de L’Argentière, qui venaient souvent chez lui.

Dans son jugement, Niroshni Ramsoondar écrit que la Cour a été très prudente sur les témoignages des victimes et a pris en considération quethe  case/s against Accused rests and falls upon their testimonies.

Autre point important dans ce verdict porte le temps qu’a pris les victimes de ces abus sexuels de venir de l’avant. La magistrate a donné sa réponse:

“The lateness in reporting the matter is not questioned by the Court. The Court has nothing to say as regards the coping mechanism of victims of sexual abuse. Each have their own demons…”

Très important également le stand adopté par le magistrat qui dit que la Cour peut condamner en l’absence des preuves irréfutables. “It is trite law that the Court can convict on uncorroborated evidence if the Court is alive to the danger of same and certain that a declarant is worthy of belief and his/her testimony is safe and reliable. Indeed, where sexual offences are concerned, corroboration is desirable albeit not required as a matter of law or practice”, a écrit la magistrate Niroshni Ramsoondar

Cette dernière, après avoir analysé les points de la poursuite sur les charges 1,2,9, 18, 19, 20 et 21, a jugé Joseph Marie Louis Michel de Ravel de l’Argentière coupable.

La section 249 du Code criminel sur laquelle Joseph Marie Louis Michel de Ravel de l’Argentière a été jugée

249 Rape, attempt upon chastity and illegal sexual intercourse

(1) Any person who is guilty of the crime of rape, shall be liable to penal servitude for a term which shall not be less than 5 years.

(1A) Notwithstanding any other enactment, where a person is convicted of an offence under subsection (1), the Intermediate Court shall have

  • (a) jurisdiction to inflict penal servitude for a term not exceeding 20 years;
  • (b) power to order sentences of penal servitude to be served consecutively, provided that the terms of such sentences shall not in the aggregate exceed 20 years.

(1B) Notwithstanding any other enactment, prosecution for the offence of rape may, at the sole discretion of the Director of Public Prosecutions, take place before a Judge without a jury where it is averred that the offence of rape was committed by 2 or more individuals.(1C) Sections 151 and 197 of the Criminal Procedure Act, and the Probation of Offenders Act, shall not apply to a conviction for the offence of rape.

(2) Any person who commits an indecent act ‘attentat à la pudeur’ by force or without consent upon a person of either sex, shall be liable to penal servitude for a term not exceeding 5 years.

(3) Any person who commits an indecent act ‘attentat à la pudeur’, even without violence and with consent, upon a child of either sex under the age of 12 shall be liable to penal servitude for a term not exceeding 5 years.

(4) Any person who has sexual intercourse with a minor under the age of 16 or a mentally handicapped person, even with his consent, shall be liable to penal servitude for a term not exceeding 10 years (5)

(a) Any person who has sexual intercourse with a specified person, even with consent, shall commit an offence and shall on conviction, be liable to penal servitude.

(b) Any person who commits an indecent act ‘attentat à la pudeur’, even without violence and with consent, upon a specified person shall commit an offence and shall, on conviction, be liable to penal servitude for a term not exceeding eight years.

(c) In this subsection, “specified person”– (i) means any person who, in relation to the person charged, comes within the prohibited degrees set out in articles 151, 152 and 153 of the Code Napoléon; (ii) includes (A) a stepchild or an adopted child, of whatever age, of the person charged;

(B) a child of whatever age whose custody or guardianship has been entrusted to the person charged by virtue of any other enactment or of an order of a Court;

(C) a child of whatever age or a mentally handicapped person, other than the spouse of, but living under the same roof as, the person charged or who is the child of the partner of the person charged.

(6) No prosecution shall be instituted under this section except on an information filed with the consent of the Director of Public Prosecutions.

(7) It shall be a sufficient defence to any prosecution under subsection (3) or (4) that the person charged had reasonable cause to believe that the child was above the age of 12 or 16, as the case may be.
